Terms of Service

Last updated 27 October 2026.

Working draft pending professional legal review. Signed project proposals and contracts take precedence over this page.

About these terms

These terms cover your use of this website and the general basis on which Daniel Shammah Web Studio (the trading name of Daniel Shammah, based in Malaysia) provides services. Each project is also governed by a written proposal or contract. Where that document differs from this page, the signed document applies.

Information on this website

Prices on this website are starting prices in US dollars and are not offers. A price becomes binding only in a proposal you accept. Projects labelled "Studio concept" are demonstrations for fictional businesses, not client work.

Proposals and scope

Before work starts we agree a proposal describing deliverables, exclusions, revision rounds, price, payment schedule and an expected timeline. Work outside that scope, including major revisions, new functionality, copywriting and photography unless included, is quoted separately and starts only after you approve it in writing.

Your responsibilities

  • Provide content, brand material, access and feedback within reasonable time. Delays in these may move the schedule.
  • Make sure you have the rights to the material you give us (text, images, logos).
  • Review and approve deliverables at each milestone.
  • Remain responsible for your business's legal obligations, such as privacy notices, terms of sale and tax settings on your own website.

Payments

Payment terms, deposits, refunds and cancellations are described on the Payment and Cancellation Terms page and in your proposal.

Intellectual property and ownership

Ownership and licensing of agreed deliverables are defined in the project contract. Unless the contract says otherwise, on full payment you receive ownership of, or a perpetual licence to use, the custom design and code created specifically for your project. Third-party software, fonts, stock media and plugins remain subject to their own licences. The studio's proprietary development tools and infrastructure, including UXAI, remain the studio's property and are not part of the deliverables. We may show completed work in our portfolio unless you ask us not to.

Third-party services

Websites often rely on third-party services such as hosting, domains, payment processors and content management systems. These are billed separately unless included in the proposal, are governed by their providers' terms, and we are not responsible for their outages, price changes or policy changes.

Warranties and liability

We carry out work with reasonable skill and care and fix defects in our own work that you report within 30 days of launch at no charge. We do not guarantee specific business results, search rankings or uninterrupted availability. To the extent the law allows, our total liability for a project is limited to the amount you paid for that project, and we are not liable for indirect or consequential losses.

Taxes

Prices do not include taxes. Each party is responsible for its own taxes; any tax that applies to an invoice is shown on it.

Governing law

Unless your contract says otherwise, these terms are governed by the laws of Malaysia. We will always try to resolve concerns informally first.
